Terms and Conditions

Payment

Balloon Decoration:

  • A deposit of 25% of the total cost is required for events scheduled more than six (6) weeks in advance.

  • A deposit of 50% of the total cost is required for events scheduled six (6) weeks or less in advance.

  • A deposit (full payment) of 100% of the total cost is required for events fourteen (14) days or less in advance.

A signed contract must be secured prior to any services being performed by MyLoveRose Creations.

 

The Client making their deposit is an acknowledgment and acceptance of this agreement. The deposit is deducted from the invoice total for the event. Deposits are used to secure the event on the agreed upon date(s). Any remaining balance due on your invoice, must be paid in full fourteen (14) days before the event. Failure to pay the remaining balance will result in the cancellation of the agreement, loss of the deposit, and services will not be rendered, unless otherwise notated. If MyLoveRose Creations and the Client determine that services may still be completed past the due date, a 5% late fee may be added to the remaining balance.

Event Decoration:

Contracted Services

Includes all services described on the invoice provided to client. Any additional services/products requested by the client incurred by MyLoveRose Creations will be billed directly to client at cost. All services contracted cannot be deducted, but additional services can be added.

Expiration

Current event date and contract is valid 1-week post agreement date to secure services.

Provided Documentation

All documentation created and provided to client is owned and copy written by MyLoveRose Creations and cannot be used or given to any other 3rd party.

Liability

It is understood that MyLoveRose Creations is only liable for services completed and provided by MyLoveRose Creations and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall MyLoveRose Creations be liable for consequential damages of any kind.

Cancellation & Refund Policy

Client may cancel this agreement at any time. All cancellations must be made in writing via email.

Balloon Decoration 

If the Client cancels the event fourteen (14) days or more prior to the event date, a credit of fifty (50) percent of the total contracted amount will be held on file. This credit can be applied towards another event in the future. The remaining fifty (50) percent may be refunded.

If the Client cancels the event less than fourteen (14) days prior to the event date, no refund will be provided. 

​

If MyLoveRose Creations has to cancel, a full refund will be given within 10 business days, or the Client has the option to receive a credit for future services. 

 

No refunds will be offered or honored for completed services. Client will be assumed to have accepted goods and services rendered unconditionally at time of service unless otherwise agreed or arranged.

Event Decoration

If the Client cancels the event less than thirty (30) days prior to the event date, no refund will be provided.

If MyLoveRose Creations has to cancel, a full refund will be given within 10 business days, or the Client has the option to receive a credit for future services. 

 

No refunds will be offered or honored for completed services. Client will be assumed to have accepted goods and services rendered unconditionally at time of service unless otherwise agreed or arranged.

Rescheduling Policy

Rescheduling requires at least 1 weeks' notice. We allow events to be rescheduled no later than 90 days in the future of the original event date. The Client is allowed to reschedule up to two (2) times. If the Clients decides to then cancel, the cancellation rules will apply.

 

A 5% reschedule fee may be incurred to allow adjustments to any previous outside vendor orders.

Responsibility

MyLoveRose Creations is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents not within the control of the MyLoveRose Creations. In such cases, either party may terminate the contract without penalty. Reasonable efforts will be made to reschedule the event or provide a refund of any deposits made, minus expenses incurred up to the termination date.

Changes & Substitutions

MyLoveRose Creations reserves the right to make substitutions in the event the flowers, equipment, and/or decor received are not of suitable quality for the event. The agreed color scheme, look and feel will be maintained for any changes and will not affect the services for the event.

Artistic Release

Client agrees that they have spent a satisfactory amount of time reviewing the vendor’s work, and has a reasonable expectation that the MyLoveRose Creations will perform the services in a similar manner and style unless otherwise specified. MyLoveRose Creations will use reasonable efforts to ensure Client’s desired services are produced in a style and manner consistent with MyLoveRose Creations' current portfolio and will try to incorporate any reasonable suggestions made by the Client. 

However, Client understands and agrees that:

  1. Every client and event is different., regarding tastes, budget, and needs.

  2. Event services are often a subjective art and vendor has a unique vision, with an ever-evolving style and technique.

  3. MyLoveRose Creations will use artistic judgment when providing services for client, which may not include strict adherence to client’s suggestion.

  4. Although MyLoveRose Creations will use reasonable efforts to incorporate the client’s suggestions and desires when providing client with services, vendor shall have final say regarding aesthetic judgment and artistic quality of the services.

  5. Dissatisfaction with MyLoveRose Creations' aesthetic judgement or artistic abilities are not valid reasons for termination of this agreement or request of any monies returned.

Contracted Vendor & Payments 

Any rentals and/or subcontracted vendors contracted on behalf of client will be paid in full to MyLoveRose Creations directly at requested deadline. Proper notice will be provided per cost.

Negotiations with outside vendors is the responsibility of the Client; especially if special accommodations must be made in order to complete the agreed upon services. Reimbursements will not be made for unused or damaged items following guidelines from other vendors and/or venue management.

Damage or Loss of Accessories

Client agrees to exercise all due care in caring for, and preserving the property of MyLoveRose Creations. Clients shall remain responsible for all loss or damage to rentals, up to and including actual replacement value for each missing or damaged item per cost.

Attorney

If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in addition to any other remedies to which that party might be legally entitled.

Appropriate/ Safe Working Environment

The Client(s) expressly agree(s) to take best efforts to provide MyLoveRose Creations with safe and appropriate working conditions. In the event of circumstances deemed by either MyLoveRose Creations or a bystander to present a threat or implied threat of injury or harm to MyLoveRose Creations or equipment, MyLoveRose Creations reserves the right to cancel all services remaining under this Agreement and leave the event. At MyLoveRose Creations discretion, MyLoveRose Creations may enact a three-strike policy. After the first offense, the MyLoveRose Creations will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), MyLoveRose Creations shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the event. If the behavior occurs a third time, MyLoveRose Creations will immediately leave the event. If MyLoveRose Creations leaves the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold MyLoveRose Creations harmless as a result of incomplete event coverage, or for a lapse in the quality of the MyLoveRose Creations' work, and the Client(s) shall be responsible for payment in full.
